Friends and Comrades,
This 1st July brings tougher struggles and enormous challenges –
       Our struggle against gigantic cement multinational Holcim-Lafarge
has reached a crucial point with the old ACC Jamul plant employing
hundreds of contract workers to be closed and a huge new expansion
plant to be commissioned. Pragatisheel Cement Shramik Sangh is
fighting hard against retrenchment, victimization and bias against
local workers, and to unite cement workers across unions to protect
the gains of the Cement Wage Board agreement for contract workers.
       CMM (Mazdoor Karyakarta Committee) is a part of the struggles of the
peasantry of Bhilai-Durg and Rajnandgaon against the pro-corporate
plans of industrial corridor and smart city. It is actively
participating in the struggles of the larger anti-displacement
platform Chhattisgarh Bachao Andolan fighting for rights of tribals
under PESA and FRA and against polluting and ecologically devastating
mining in Raigarh and Sarguja, diversion of land and water from
agriculture, and unnecessary and unsustainable mushrooming of power
plants in Janjgir and Korba, and neglect of adivasi interests in the
loot of minerals in Bastar.
       The Mahila Mukti Morcha continues the struggle for a strong working
class women’s  movement, fighting patriarchy within the bastis and the
union, and sexual violence and repression in  the society at large.
Women’s solidarity could resist several incidents in Bhilai, Raipur
and Raigarh.
       The Mehanatkash Awas Adhikar Manch is solidly standing with slum
dwellers in Mazdoor Nagar, Amlidih, Hospital Sector, Ghasidas
Nagar….and many more, resisting eviction, fighting for basic
amenities. The Shaheed School, with its young women teachers from the
basti is trying to evolve teaching methods that are scientific, fun
and liberating for working class children.
       CMM is deeply aware of the growing attacks on dalits and minorities
in Chhattisgarh in the present political scenario, and participates
actively in all efforts to protest such attacks and act in solidarity.
We are making conscious efforts to educate our union members regarding
these issues.
       Participating in the “Sanyukt Trade Union Manch”, CMM is a part of
militant collective efforts to oppose the changes in labour laws
designed to dilute rights and weaken unions. Particularly in
Chhattisgarh, the industrial working class is a significant force, and
can lead a struggle for just use of rich resources for the people of
Chhattisgarh as Comrade Niyogi envisaged.
       Even as numerous large and small movements arise in Bastar to oppose
mega steel plants, Bailadila expansion, Polavaram dam and iron ore
mining in Rowghat;  the increase in security forces being deployed,
setting up of an Army command area in Chakarbhata  Bilaspur and air
base for UAVs in Nandini Bhilai point to an upscaling of the “war”
against  Bastar. While the Indian Govt refuses to accept the conflict
in Bastar as an “internal armed conflict” in the international arena,
as that would mean accepting international monitoring, it continues to
treat it as the “greatest internal security threat”. This is indicated
by the ratio of security forces per lakh of population – more than
1770 in Bastar as compared to 139 in India, 169 in Chhattisgarh and
about 800 in Kashmir. The recent statement of DG CRPF Prakash Mishra
made in Koraput that “drones may be used to target Maoist camps deep
inside jungles” belies the official theory that India, the largest
purchaser of both surveillance and fighter drones in the world this
year, is only going to use these for intelligence.
“Injustice anywhere is a threat to justice everywhere.” CMM has been
opposing the long incarcerations of ordinary adivasis, fake encounters
and surrenders, and targeting of human right defenders in the name of
combatting Naxals in Bastar. It will stoutly continue to do so, in the
even more difficult days to come.
Friends, on this 1st July we also mourn the death of Comrade Phaguram
Yadav of Dalli Rajhara – an iron ore miner, talented folk singer and
the voice of the working class struggle, close comrade of Shankar Guha
Niyogi, who passed away in the month of June 2015.
CMM could not have withstood the repression it has faced in terms of
criminal cases and arrests of its leaders, and the tough class battle
that is on with a multinational of the size of Holcim-Lafarge; or been
able to chart out new organizational ground among working class women;
or been able to persist with its programmes of “Nirman” like the
Shaheed School without the solidarity, support and critical engagement
with all of you. That is our most precious resource.

begin at Comrade Niyogi’s statue in Bhilai Industrial Area at 12 noon
and the mass meeting will be at Bachat Stambh, near Powerhouse Railway
station (where 17 comrades were martyred on 1st July 1992) at about 3

Abuses by security forces among most significant human rights problem in India : US report

Abuses by police and security forces were among the most significant human rights problems in India last year, a US government report on Thursday  said even as it noted last year's Indian general election as the largest ever in history.

"India's parliamentary contest in April 2014 was one of the largest elections in history," Secretary of State John Kerry said in his preface to the State Department's annual Congressional-mandated report in which he noted that around the world, more people chose their leaders in competitive elections than ever before. The lengthy India section of the report says that the 2014 general elections, the largest democratic elections in history, were considered free and fair, despite isolated instances of violence.

Authorities maintained effective control over the security forces. "The most significant human rights problems were police and security force abuses, including extra-judicial killings, torture, and rape; widespread corruption that contributed to ineffective responses to crime, including those against women and members of scheduled castes or tribes; and societal violence based on gender, religious affiliation, and caste or tribe," the report said.

According to the State Department report, other human rights problems included disappearances, hazardous prison conditions, arbitrary arrest and detention, and lengthy pretrial detention. "The judiciary remained backlogged, leading to lengthy delays and the denial of due process," it said. Noting that there were instances of infringement of privacy rights, the report said the law in some states restricts religious conversion, and there were reports of arrests but no reports of convictions under those laws. Some limits on the freedom of movement continued.

Rape, domestic violence, dowry-related deaths, honour killings, sexual harassment, and discrimination against women remained serious societal problems, it said. Child abuse and forced and early marriage were problems, the State Department said. Human trafficking, including widespread bonded and forced labour of children and adults, and sex trafficking of children and adults for prostitution were serious problems, it said.

आदिवासियों की जमीन हड़प रहा गिरोहरोक लगे वर्ना होंगे घातक परिणाम क्या है मामला  रायगढ़ निवासी घसिया आत्मज कैरा जाति खडिया ने राजस्व मंडल के पूर्व अध्यक्ष टी. राधाकृष्ण के समक्ष २ दिसबंर को राजस्व संहिता की धारा ८ के तहत आवेदन किया कि रायगढ़ जिले के ग्राम बड़े अतरमुंडा स्थित अपनी जमीन ०.२४७ हेक्टेयर को वह गगन राठी को बेचना चाहता है आवेदक खडिया आदिमजाति का है, इसलिए उसे जमीन बेचने के लिए कलेक्टर की अनुमति आवश्यक है, लेकिन रायगढ़ कलेक्टर ने विक्रय की अनुमति प्रतिबंधित कर रखी है इसी आवेदन में कहा गया कि आदिम जाति अनुसंधान संस्थान ने ७ जनवरी २००८ के एक पत्र में खुलासा किया है कि खडिया किसी भी राज्य की आदिम जनजाति की सूची में नहीं है तत्कालीन अध्यक्ष राजस्व मंडल ने अगले दिन यानी ३ दिसंबर, २०१० को उस जमीन को बेचने की अनुमति धारा १६५(६) एवं १६५(७) के तहत प्रदान की इस मामले सहित इसी तरह के कई अन्य मामलों को राजस्व मंडल के मौजूदा अध्यक्ष श्री मिश्र ने कतिपय अनियमितता पाए जाने पर धारा ५१ के तहत स्वमेव पुनर्विलोकन में ग्राह्य किया छल-कपट ऐसे हुआ राजस्व मंडल की चेतावनी  पट्टेधारियों के फर्जी आवेदन से जमीन के हस्तांतरण के ५० मामलों के पुनरावलोकन से खुला राज-॥-राजस्व मंडल के पूर्व अध्यक्ष ने दिया था कानून के खिलाफ स्वेच्छाचारी फैसला क्या है गड़बड़ी जिया कुरैशी रायपुर छत्तीसगढ़ में राजस्व मामलों की सुनवाई के दौरान संभवतः पहली बार राजस्व मामलों के न्यायालय ने बेहद नाराजगी के साथ कहा है कि रायगढ़ जिले में कपटपूर्ण तरीके से गरीब, अनपढ़ आदिवासियों की जमीन हड़पने के लिए कोई गिरोह काम कर रहा है इसे यदि नहीं रोका गया तो इसके घातक परिणाम होंगे  ।छत्तीसगढ़ राजस्व मंडल के अध्यक्ष डीएस मिश्र ने एक पुनर्विलोकन मामले में जारी आदेश में यह बात कही है खास बात यह है कि आदिवासियों की जमीन हड़पने के ऐसे बहुत से मामलों में राजस्व मंडल के पूर्व अध्यक्ष टी. राधाकृष्णन के न्यायालय से कानून विरोधी आदेश जारी कर आदिवासियों की जमीन गैर-आदिवासियों को हस्तांतरित की गई है  राजस्व मंडल ने आदिवासियों की जमीन गैर-आदिवासियों को बेचे जाने संबंधी कई मामलों की सुनवाई के दौरान पाया है कि करीब ५० मामलों में राजस्व मंडल के पूर्व अध्यक्ष ने एक ही प्रकार के आदेश जारी किए हैं  ताजा मामले में राजस्व मंडल ने पूर्व अध्यक्ष द्वारा जारी किए गए आदेश को विधि विरुद्ध और स्वेच्छाचारी कहा है छत्तीसगढ़ शासन विरुद्ध घसिया, गगन राठी के मामले में पाया गया है कि समस्त प्रकार के विधिक प्रावधानों तथा कानूनी प्रक्रिया का उल्लंघन करते हुए जिस हड़बड़ी के साथ इस प्रकरण में कार्रवाई की गई है और मात्र दो दिन में आदेश पारित किया गया है, उससे यह आदेश स्पष्टतः दुर्भावनापूर्ण एवं कानूनी प्रक्रिया का दुरुपयोग होना प्रतीत होता है राजस्व मंडल के पूर्व अध्यक्ष के कार्यकाल में धारा १६७(७-बी) के तहत शासकीय पट्टे की जमीन विक्रय की अनुमति से संबंधित ५० मामलों मे पट्टाधारियों ने राजस्व मंडल में उपस्थित होकर बताया कि उन्होंने कभी भी अपने पट्टे की भूमि को बेचने का सौदा नहीं किया, न ही बेचने के लिए अनुमति का कोई आवेदन किया और न ही आवेदन पर उनका हस्ताक्षर है इन्ही में से एक बीरबल नामक व्यक्ति के आवेदन में उसके अंगूठे का निशान है,  जबकि न्याायालय में प्रस्तुत उसके आवेदन में हस्ताक्षर दर्ज है घसिया के प्रकरण में दर्ज हस्ताक्षर के फर्जी होने की आशंका राजस्व मंडल ने जताई है यानी जिन आदिवासी लोगों के नाम की जमीन गैर-आदिवासियों के नाम करने राजस्व मंडल के पूर्व अध्यक्ष के समक्ष आवेदन प्रस्तुत किए गए, वे पूरी तरह फर्जी थे, लेकिन उनमें जमीन गैर-आदिवासियों के नाम करने के आदेश जारी किए गएपुनर्विलोकन में पाया गया कि आदिम जनजातियों की सूची में खडिया शामिल है यानी न्यायालय के आवेदक घसिया ने गलत जानकारी दी तत्कालीन राजस्व मंडल के अध्यक्ष आवेदक द्वारा दी गई गलत जानकारी को ही मान्य किया जमीन बेचने की अनुमति देने से पहले उस पत्र की जांच भी नहीं की गई, जिसके मुताबिक खडिया को आदिम जाति न होने की बात कही गई थी जिस धारा के तहत जमीन बेचने का आदेश दिया गया था, उसके तहत राजस्व मंडल को जमीन बेचने की अनुमति देने का अधिकार ही नहीं है  यह भी पाया गया कि तत्कालीन अध्यक्ष ने धारा ८ के तहत न्यायिक शक्तियों का प्रयोग करते हुए आदेश पारित किया, वह भी कानून के अनुरूप नहीं है इस मामले में तत्कालीन सरकारी वकील की भूमिका भी संदिग्ध पाई गई है आदेश में लिखा गया है- सबसे चौंकाने वाला तथ्य यह है कि आवेदक की बी-वन की प्रति १९६७ की है, जो प्रमाणित नहीं है इस अप्रमाणित अभिलेख को मान्य करते हुए उक्त भूमि के मालिकाना हक की जांच किए बिना विक्रय की अनुमति दी गई है इसे भी विचित्र तथ्य माना गया है कि धारा १६७(७) के तहत शासकीय पट्टे की जमीन के विक्रय की अनुमति दी जा सकती है, लेकिन आवेदक की भूमि निजी थी क्या है मामला  रायगढ़ निवासी घसिया आत्मज कैरा जाति खडिया ने राजस्व मंडल के पूर्व अध्यक्ष टी. राधाकृष्ण के समक्ष २ दिसबंर को राजस्व संहिता की धारा ८ के तहत आवेदन किया कि रायगढ़ जिले के ग्राम बड़े अतरमुंडा स्थित अपनी जमीन ०.२४७ हेक्टेयर को वह गगन जाति अनुसंधान संस्थान ने ७ जनवरी २००८ के एक पत्र में खुलासा किया है कि खडिया किसी भी राज्य की आदिम जनजाति की सूची में नहीं है तत्कालीन अध्यक्ष राजस्व मंडल ने अगले दिन यानी ३ दिसंबर, २०१० को उस जमीन को बेचने की अनुमति धारा १६५(६) एवं १६५(७) के तहत प्रदान की इस मामले सहित इसी तरह के कई अन्य मामलों को राजस्व मंडल के मौजूदा अध्यक्ष श्री मिश्र ने कतिपय अनियमितता पाए जाने पर धारा ५१ के तहत स्वमेव पुनर्विलोकन में ग्राह्य किया इसी आधार पर जाहिर हुई जमीन हड़पने वाले गिरोह की आशंका : राजस्व मंडल ने आदेश में इन सभी मामलों पर गौर करने के बाद अपने आदेश में कहा है कि इससे स्पष्ट है कि संपूर्ण कपटपूर्ण कार्रवाई के पीछे कोई गिरोह सक्रिय है और सुनियोजित ढंग से इन गरीब अनपढ़ पट्टेधारियों तथा आदिम जनजाति के रायगढ़ जिले के भूमि स्वामियों कि जमीन हड़पने का काम कर रहा है आदेश में लिखा गया है-दिलचस्प बात यह है कि इन सभी प्रकरण में खरीदार मात्र दो व्यक्ति गगन राठी और पवन चौहान, जो रायगढ़ निवासी हैं, यही लोग इस गिरोह के सरगना हो सकते हैं
